By downloading, installing, accessing, or using our mobile application (the "App") in any way, you automatically and completely agree to be bound by these Terms and Conditions ("Terms"). Your use of the App constitutes full acceptance of all terms outlined in this document.
If you do not agree with any part of these Terms, you must immediately discontinue use of the App and uninstall it from your device. There is no partial agreement - using the App means you accept all terms completely.
2.1 You must be at least 13 years old to use our App. If you are under 18, you represent that you have your parent or guardian's permission to use the App.
2.2 You agree to use the App only for lawful purposes and in accordance with these Terms. You agree not to use the App in any way that could impair the proper functioning of the App.
3.1 Our App allows you to input your feelings and experiences to receive uplifting messages. While you retain ownership of the underlying emotions and experiences you share, you grant us comprehensive usage rights as outlined below.
By using the App, you grant us a worldwide, perpetual, irrevocable, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, distribute, and display your upliftment content for any purpose, including but not limited to:
Important: All such usage will maintain complete anonymity. We will never link your content to your identity in any way - no names, emails, personal identifiers, or any information that could identify you will ever be associated with your content when used for these purposes.
3.3 Data Retention for Usage: Content may be retained on our servers beyond the standard 30-day deletion period if selected for promotional usage, but always in completely anonymous form.
3.4 You are solely responsible for the content you submit and agree not to submit any content that is unlawful, offensive, or violates any third-party rights.
4.1 The App and its original content, features, and functionality are owned by Stay Uplifted and are protected by international copyright, trademark, and other intellectual property laws.
4.2 You may not modify, reproduce, distribute, create derivative works or adaptations of, publicly display or in any way exploit the App except as expressly authorized by us.
5.1 Our App includes an optional donation feature that allows users to voluntarily support the development and maintenance of the App.
5.2 All donations are voluntary and non-refundable. By making a donation, you acknowledge that you are doing so voluntarily and do not expect any goods, services, or benefits in return beyond continued access to the App.
5.3 Support contributions are processed through Apple App Store and Google Play Store's secure in-app purchase systems. We do not store your payment information on our servers. All transactions are handled directly by Apple or Google.
5.4 Donation records, including payment references and any optional information you provide, may be retained for record-keeping and legal compliance purposes.
5.5 We reserve the right to modify or discontinue the donation feature at any time without prior notice.
6.1 Your privacy is important to us. Please refer to our Privacy Policy for information on how we collect, use, and disclose personal information from our users.
Upliftment content stored on our servers will most likely be automatically deleted after 30 days from the date of creation, except for content that may be retained for anonymous promotional usage as outlined in Section 3. Local data on your device is not subject to this automatic deletion.
7.1 Analytics Data Collection: We collect anonymous analytics data through Firebase Analytics and Google Analytics 4 to understand app usage patterns, improve functionality, and enhance user experience.
By using the App, you grant us the right to collect, analyze, and use anonymous analytics data including:
7.3 Data Anonymity: All analytics data is anonymized and cannot be linked to your personal identity. No emotional content, personal descriptions, or identifying information is included in analytics data.
7.4 Third-Party Processing: Analytics data may be processed by Google (Firebase Analytics/Google Analytics 4) to provide insights about app performance and user experience.
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
8.2 The uplifting messages provided by our App are generated using Google's Gemini AI service along with content from Bible verses, wise books, and creative sources. These messages are for emotional support and inspiration only and should not be considered professional advice. They are not a substitute for professional counseling, therapy, or medical advice.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE APP.
10.1 We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
11.1 By using Stay Uplifted, you acknowledge that you have read, understood, and completely agree to all Terms and Conditions outlined in this document. Your use of the App serves as your electronic signature and binding agreement to these Terms.
11.2 These Terms, together with our Privacy Policy, constitute the complete agreement between you and Stay Uplifted regarding your use of the App.
